Welcome to the Monterey Bay Moves Website. It is our pleasure to provide the services described below in accordance with these Terms of Use (“Terms”). We congratulate you in taking a first step to improve your health. We value your wellbeing and your health, and for such reason, we ask you to carefully read all our terms. By Agreeing to these terms, you state that you have read this document.

BINDING EFFECT. This is a binding agreement. By using the Internet site located at www.montereybaymoves.com (the “Site”) or any services provided in connection with the Site (the “Service”), you agree to abide by these Terms of Use, as they may be amended by Monterey Bay Moves, Inc. DBA Monterey Bay Moves (“Company”) from time to time in its sole discretion. Company will post a notice on the Site any time these Terms of Use have been changed or otherwise updated. It is your responsibility to review these Terms of Use periodically, and if at any time you find these Terms of Use unacceptable, you must immediately leave the Site and cease all use of the Service and the Site.

YOU AGREE THAT BY USING THE SERVICE YOU REPRESENT THAT YOU ARE AT LEAST 18 YEARS OLD AND THAT YOU ARE LEGALLY ABLE TO ENTER INTO THIS AGREEMENT.

INFORMED CONSENT.

PURPOSE AND EXPLANATION OF THE TESTS AND EXERCISE PROGRAM

Personal Training: You will perform submaximal cardiovascular tests. The exercise intensity will be moderate to vigorous. I may stop the tests at any time because of signs of fatigue or changes in my heart rate or blood pressure, or symptoms I may experience. I understand I may stop when I wish because of discomfort. I understand that my physical fitness program is individually tailored to meet the goals and objectives agreed upon with my personal trainer. Group Training Classes and Bootcamp: I may stop the tests or exercise at any time because of signs of fatigue or changes in my heart rate or blood pressure, or symptoms I may experience. I understand I may stop when I wish because of discomfort. I understand that the physical fitness program is designed to accommodate multiple individuals with varying goals and fitness levels.

DESCRIPTION OF THE EXERCISE PROGRAMS

I understand that my exercise program will involve participation in a number of types of fitness activities. These activities will vary depending upon the objectives that my personal trainer and I establish, but will probably include: 1) aerobic activities including, but not limited to, the use of bike/run trail, beach/local park premises 2) muscular endurance and strength building exercises including, but not limited to, the use of free weights, calisthenics, resistance bands, and exercise apparatus; 3) other activities selected by my personal trainer and agreed upon by me; and 4) selected physical fitness and body composition tests.

DESCRIPTION OF POTENTIAL RISKS

I understand that no exercise program is without inherent risks regardless of the care taken by a personal trainer and that my personal safety cannot be guaranteed by my personal trainer. I realize that when participating in any exercises, particularly those that induce cardiovascular stress, there is a slight chance of serious injury (e.g., heart attack, stroke, or other cardiovascular accidents) or catastrophic incident (e.g., death, paralysis). Likewise, I know that engaging in muscular endurance, strength building, and other fitness activities sometimes results in minor injuries (e.g., bruises, musculoskeletal strains and sprains), less frequent, more serious injuries (e.g., muscle tears, herniated disks, torn rotator cuffs), and rarely, catastrophic injury (e.g., death, paralysis). Monterey Bay Moves’ personel is trained in CPR/AED to deal with unusual situations that may arise.

DESCRIPTION OF POTENTIAL BENEFITS

I understand that a regular exercise program has been shown to have definite benefits to general health and well-being. I know that some of the benefits can include loss of weight, reduction of body fat, improvement of blood lipids, lowering of blood pressure, improvement of cardiovascular function, reduction in the risk of heart disease, improved strength and muscular endurance, improved posture, and improved flexibility.

PARTICIPANT RESPONSIBILITES

I understand that it is my responsibility to 1) fully disclose any health issues or medications that are relevant to participation in a strenuous exercise program; 2) cease exercise and report promptly any unusual feelings (e.g., shortness of breath with low-level activity; pain; pressure tightness; heavines in the chest, neck, jaw, back and/or arms, nausea, and apparent injury) during the exercise program; and 3) clear my participation with my physician. Your prompt reporting of any symptom and unusual feeling with effort during the exercise test or program session is very important. You are responsible for fully disclosing your medical history as well as symptoms that may occur.
